1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of the Souper mobile application and related services (the “App” or “Service”). By downloading, accessing, or using Souper, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Eligibility and Age Requirements
You must be at least 13 years old to use Souper. If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, you must be at least 16 years old (or have valid parental/guardian consent where permitted by law).
Souper is not directed to children under 13, and we do not knowingly permit accounts for users under 13.
3. The Service
Souper helps you privately and publicly, depending on the feature you use:
- Import recipes from URLs and supported sources
- Organize recipes and meal plans
- Extract and structure ingredients using AI processing
- Create shopping lists
- Store one image per recipe
- Post recipes, captions, images, profile details, and related content to social or public areas of the Service when you choose to publish them
4. In-App Browser and Third-Party Content
The App may include an in-app browser that allows you to view third-party websites. We do not control, endorse, or assume responsibility for third-party content, availability, ads, tracking technologies, or practices. Your interactions with third-party websites are between you and them.
5. Your Content and Ownership
You retain ownership of the content you import, store, post, or otherwise provide in Souper (“User Content”). Private recipe and meal-planning features are intended for private, individual use. Social posting, profile, and published recipe features may make User Content publicly visible to other users or visitors.
5.1 Public User Content and Platform Role
Recipes, captions, images, profile information, comments, and other public materials are owned and provided by the user or poster who submits them, not by Souper. Souper provides a platform, hosting service, discovery surface, and related tools for users to post and organize recipe-related content. We do not endorse, verify, or guarantee user-posted content, including its originality, accuracy, legality, safety, nutrition information, allergen suitability, ownership, or compliance with third-party rights.
The poster is solely responsible for their User Content and for ensuring they have all rights, permissions, licenses, and consents needed to submit, publish, display, and share that content through the Service.
5.2 Copyright and Acceptable Use (Onboarding-Friendly)
You are responsible for ensuring you have the right to import, store, post, publish, and use any recipe or content. Do not import, store, post, or publish content that infringes copyright, violates terms of a website, violates privacy or publicity rights, misleads users, or is unlawful.
Souper does not allow manual pasting of full recipe text. Imported recipe data may include metadata, ingredients, and other structured data. Recipe instructions are stored privately and encrypted using an on-device key (so they are intended to be unreadable without your device key).
5.3 Content Moderation and Removal
We may remove, disable access to, limit distribution of, or refuse to publish User Content at any time if we reasonably believe it infringes another person’s copyright or other rights, violates these Terms, creates legal or safety risk, is misleading or abusive, or is otherwise inappropriate for the Service. We may also suspend or terminate accounts involved in repeat or serious violations.
We may preserve or disclose information related to disputed User Content when required by law, to enforce these Terms, to respond to rights-owner complaints, or to protect users, Souper, or third parties.
6. AI Processing and Disclaimer
Souper uses third-party AI services (currently Groq) to process recipe text and/or related data for features such as ingredient extraction and structuring (“AI Processing”).
- AI Processing may be inaccurate, incomplete, or misleading.
- You must verify outputs before relying on them (especially allergens, dietary needs, cooking times, and food safety).
- AI outputs are provided for convenience and do not constitute professional advice.
7. Accounts, Security, and Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
8. Ads, Subscriptions, and Payments
Souper may offer a free tier supported by advertising and a paid subscription tier with additional features (such as ad removal).
8.1 App Store and Google Play Billing
If you purchase a subscription:
- Apple App Store: purchases, renewals, cancellations, and refunds are handled by Apple under Apple’s terms.
- Google Play (future): purchases, renewals, cancellations, and refunds will be handled by Google under Google’s terms.
We do not store your full payment card details. Billing platform providers may provide us limited purchase status information (e.g., subscription active).
9. Data Export / Portability
We support data export to help you access or move your data. You may request an export (e.g., common machine-readable format) by contacting support@souper.cc. We may need to verify your identity before fulfilling requests.
10. Account Deletion and Termination
You can delete your account in-app. Upon deletion, we delete your account data immediately (subject to brief, limited technical delay for backup rotation and security logs as described in the Privacy Policy).
We may suspend or terminate access if you violate these Terms, misuse the Service, or if required by law.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Two Stones, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from your use of the Service.
Our total liability for any claim will not exceed the greater of: (a) amounts you paid to us for the Service in the 12 months before the event, or (b) CAD $50.
13. Copyright Complaints (DMCA-Style Notice)
If you believe content in the Service infringes your copyright, contact: support@souper.cc
Provide: your contact info, identification of the copyrighted work, identification of the allegedly infringing material, and a statement that you have a good-faith belief the use is not authorized.
14. Governing Law
These Terms are governed by the federal laws of Canada and applicable laws in force in Canada, without regard to conflict of law principles. Any dispute will be brought in Canada.
15. Changes to These Terms
We may update these Terms from time to time. We will update the Effective Date and, where appropriate, provide notice in-app. Continued use after changes means you accept the updated Terms.
